Mr. Crutchley
The Governor has asked in his telegram at (1) that he may be authorised to dispose of Crown lands without public auction in special cases for a period of one year. I assume that questionsproposals similar to these must have arisen from time to time in other Colonies and I should be grateful to know if your Department has any comments on the question of policy raised. In particular it would be useful if, assuming that the Governor's proposal is approved, we could give him some assistance in guarding against the dangers which the normal practice of putting Crown lands up to public auction is designed to prevent.
The only legal provisions which we have been able to trace relating to Crown lands in Hong Kong
are:-

Article XIII of Letters Patent; Article XXXI of Royal Instructions; Ordinance No. 10 of 1900 (flagged in volume
attached). x
The Ordinance refers to the resumption of Crown lands required for public purposes but nevertheless the provisions of Section 15 indicate that the system of public auction need not necessarily apply in all cases.
